Supreme Court forms general position on direct application of Constitution and European Convention on Human Rights

Skopje, 23 February 2023 (MIA) - The Supreme Court of the Republic of North Macedonia has formed a general position on the direct application of the Constitution and the European Convention on Human Rights regarding complaints against Judicial Council decisions.

The general position relates to the direct appliction of provisions from the Constitution and the European Convention on Human Rights that guarantee the right to a complaint, court protection and effective remedy.

Supreme Court President Besa Ademi said the issue represents a big challenge for the court.

"Forming a general position has an enormous, maybe even historic significant for the judiciary, the court system and human rights. This position should not be seen as one relating to an individual case but as one having a broader societal and legal significance, since it creates a case law from the aspect of applying the standards of the European Court of Human Rights," said Ademi.
