Kostadinovski – Geer: Constitutional Court is key to ensuring balance among three branches of government

Skopje, 17 July 2024 (MIA) – President of the Constitutional Court Darko Kostadinovski and the judges Tatjana Vasikj Bozadzieva and Ana Pavlovska Daneva met on Tuesday with the EU Ambassador David Geer and his associates.

Ambassador Geer emphasized that he recognizes the Constitutional Court’s role in ensuring balance among the three branches of government in the constitutional order and supporting the rule of law.

Kostadinovski informed Geer that all cases of broader public interest will be on the Constitutional Court’s agenda in September and October.

He also briefed Geer on the reforms that the Constitutional Court will implement starting in September with the adoption of a new act, aimed at improving the Court’s operations.

The emphasis, as stated in the press release, was placed on provisions that will promote the acceleration of procedures and accountability for both judges and the president of the court regarding the duration of case processing.

Kostadinovski highlighted the importance of the new measure allowing the Constitutional Court to prepare special reports in cases of ongoing violations of the Constitution or laws by initiators of general acts.

Kostadinovski highlighted a major new provision in the new act of the Constitutional Court, which enables the court to set specific deadlines for regulators to amend constitutionally problematic provisions to prevent legal vacuums and protect citizens’ rights.

Ambassador Geer expressed interest in the proposals on the Constitutional Court law and the introduction of constitutional complaints, while offering strong support for the efforts of the Constitutional Court to enhance transparency.

“Ambassador Geer noted the rapid response and conclusion by the Constitutional Court, which warned that ending a constitutional judge’s term outside constitutional provisions is a serious breach of the Constitution and an interference with the Court’s independence and autonomy,” reads the press release.

Constitutional Court President Kostadinovski expressed gratitude for the launch of the IPA 3 project, with Ambassador Geer offering support for the project aimed at enhancing the Court’s capacities.

The meeting also featured discussions on proposed reforms in the judiciary.
