Justice Ministry: President can only issue pardons for effective sentences with new law

Skopje, 7 December 2023 (MIA) – With the new Law on Pardoning, which was reviewed and adopted by the Government on Wednesday, the President of the country can issue a pardon only for an effective sentence, and not in the stage of criminal prosecution, said the Justice Ministry in a press release.
According to the Ministry, in the process of the drafting of the law, several comparative experiences were reviewed, such as the solutions contained in the legal systems of the EU member states, and countries with similar legal systems.
The Justice Ministry said the reasons for adoption of a new Law on Pardoning arise from the shortcoming and legal gaps in the existing law, from the aspect of its practical implementation but also specification of certain aspects regulated by the law.
“The most important thing is that it contains precise deadlines, and the authorizations of all stakeholders in the process are fully specified. In addition, certain titles and terms are terminologically aligned in the new piece of legislation,” said the Ministry.
