Skopje, 13 July 2022 (MIA) – The Constitutional Court overruled Wednesday Article 12 of the Law on Nominating a Strategic Partner for Implementation of the Project for Construction of Infrastructure Corridor 8 (highway section: Tetovo – Gostivar – Bukojachani and highway section Trebenishta – Struga – Kjafasan) and Corridor 10D Prilep – Bitola highway section) in North Macedonia (“Official Gazette of Republic of North Macedonia” no.163/2021). Article 12 provides that the work hours of every worker during the entire Project can amount to an average of 60 hours per week during the year. The Constitutional Court made the decision to overrule the contested article because, the Court said in a press release, it goes against the fundamental value of the rule of law provided by Article 8 Paragraph 1 Point 3 of the Constitution, and it is contrary to Article 9 which provides that the citizens are equal before the Constitution and the law. The Court determined that this article violates the right to daily and weekly rest, i.e., it contradicts Article 32 Paragraph 4 of the Constitution. ad/ik/
