Constitutional Court: Linear pension increase is not unconstitutional

Skopje, 4 March 2026 (MIA) – The Constitutional Court said Wednesday it has halted the procedure to assess the constitutionality of Article 2 of the 2025 amendments to the Law on Pension and Disability Insurance, ending the review of the linear pension in increase. The Court noted that the proposal did not win majority support and the act remains in effect.

The Constitutional Court said that the linear increase in pensions remains in force. The suspicion of unconstitutionality of the contested law has been dismissed and the Court has halted the procedure today.

The procedure to assess the constitutionality of Article 2 of the 2025 amendments to the Law on Pension and Disability Insurance was initiated because, according to the Constitutional Court, the linear increase in pensions it envisaged therein can undermine constitutional equality, the right to property, and the principle of social security, as it treats pensioners with different contributions equally and creates disproportionate effects.

At today’s session, the Constitutional Court considered several initiatives and draft decisions and decided not to initiate proceedings regarding provisions of the Law on Consumer Protection relating to the use of the Macedonian language and the languages of communities representing at least 20 percent of the population.

According to the information, procedures will be launched concerning the Law on the Judicial Budget, specifically the provisions on the Academy for Judges and Public Prosecutors; the Family Law, regarding deadlines for paternity challenges; the Law on Industrial Property, in the part referring to a “separate body of state administration”; and the decision to rename streets and infrastructure facilities in the Municipality of Tetovo.

In addition to stopping the procedure for Article 2 of the law amending the Law on Pension and Disability Insurance, the procedure has also been stopped for parts of Article 9 of the Law on Court Case Management.
